1. Acceptance of Terms

By registering for or using Drive Planner ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service. These Terms form a legally binding agreement between you and KOS IT SERVICES ("we", "us", "our").

2. Description of Service

Drive Planner is a web-based scheduling and student management platform designed for independent driving instructors in Ireland. Features include lesson scheduling, EDT hour tracking, invite-based student management, automated email reminders, and analytics.

3. Account Eligibility

• You must be at least 18 years of age to create an account.
• Instructor accounts require a valid RSA ADI (Approved Driving Instructor) licence number. By registering as an instructor, you confirm that you hold a current, valid ADI licence.
• Learner driver accounts may only be created via an invite code issued by a registered instructor.
• You are responsible for maintaining the accuracy of your account information.

4. Free Trial

New instructor accounts receive a 30-day free trial starting from the date their account is approved. During the trial, all features are available at no charge. No credit card is required to start the trial. At the end of the trial period, continued use requires a paid subscription.

5. Subscriptions and Payment

• Subscriptions are available on monthly or annual billing cycles.
• Prices are displayed in Euro (€) and may be subject to Irish VAT at the applicable rate.
• Subscriptions auto-renew unless cancelled before the renewal date.
• Payment processing is handled by Stripe (when enabled). We do not store card details.
• We reserve the right to change pricing with at least 30 days' notice to existing subscribers.

6. Cancellation and Refunds

• You may cancel your subscription at any time from your account settings.
• Upon cancellation, your account remains active until the end of the current billing period.
• We do not offer refunds for partial billing periods unless required by law.
• Your data is retained for 30 days after cancellation before permanent deletion. You may export your data during this period.

7. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of any Irish or EU laws.
• Submit false, misleading, or fraudulent information, including ADI licence numbers.
• Attempt to gain unauthorised access to other accounts or our systems.
• Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service.
• Use automated tools to scrape, spam, or abuse the platform.
• Harass, abuse, or threaten other users through the platform.

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

8. Instructor Responsibilities

As a registered instructor, you are solely responsible for:

• Maintaining a valid RSA ADI licence at all times while using the Service.
• The accuracy of lesson records, EDT hours logged, and student information.
• Compliance with RSA regulations regarding EDT, lesson records, and instructor conduct.
• Ensuring that invite codes issued to students are used only by the intended learner.

9. Intellectual Property

Drive Planner and all associated content, design, code, and trademarks are the intellectual property of KOS IT SERVICES. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose. You may not reproduce, distribute, or create derivative works without our written permission.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific requirements. We are not responsible for any inaccuracies in RSA ADI number verification or EDT record-keeping.

11. Limitation of Liability

To the maximum extent permitted by Irish law, KOS IT SERVICES shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the Service. Our total liability for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Ireland. Any disputes shall be subject to the exclusive jurisdiction of the Irish courts.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or an in-app notice at least 14 days before changes take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
